I don't believe the motive behind this summons & complaint has any intention of it making to a Courtroom setting. Instead, I believe this was likely hatched when Rather decided to exit CBS in a quiet fashion. I, also, believe it was hatched between Rather and the Executives at CBS.
What does CBS require? Simple, they need to recover credibility. What does Dan Rather require? Even more simple, he requires a restored sense of approval, pride, and credibility. Plus, he wouldn't mind a few extra dollars for "his sacrifice" to the powers that be at CBS.
How do both parties achieve this? An undisclosed settlement by CBS to Dan Rather prior to any Civil Trial. No messy facts...no messy testimony....and the lack of any conclusive decision one way or the other as to the legitimacy of the "false memo." It was no accident that Rather made the talk show circuit playing up emotions over content. He argued himself to tears on two appearances, assuring all that the memo was real...despite the fact that we know that it wasn't. It was no accident that Mary Mapes chose that same time frame to pop up out of no where to post at the Huffington Post and make herself available to interviews.
An out of Court settlement keeps the questions alive...absolves CBS by giving the impression that Rather had a solid case for the memo being legitimate...keeps the nutcase crusader, Burkhardt out of harms way...and give Dan a nice little retirement package.
Keep in mind whom these jesters play to. The far left would have no problem swallowing something like this.
